To quote the Canadian Trackside Guide: "CN 2951-2975 are equipped like an EPA Tier 3 locomotive, but are not subject to specific EPA emissions rules and are not permitted to operate in the United States."

That must have been a concession made after they were ordered. CN typically avoids any sort of roster abnormality like that.
