This tender is quite likely the newest anywhere in North America. It has had some sheet metal work on it, notably the removal of the original coal bunker and a new, larger looking one replacing it. The ugly hand rails on it are gone, but likely OSHA will want them restored to this tender or else.

Regarding the hand railings, the OSHA standards cover General Industry and Construction. There is nothing in these standards that apply to rolling stock or other railway equipment. I spent 32 years working for the Kentucky state run KOSH program, and worked for both the Compliance Division (10 years) and the Education and Training Division (22years). The Federal Railway Administration would not even allow fatalities to be investigated by KOSH. All that the state was allowed to inspect were fixed base facilities such as Locomotive and or Car Shops. Anything that moved over the rails remained under the purview of the FRA. Unless a specific complaint were sent to the proper agency, and if that agency chose to conduct an investigation, the safety appliances seen on this tender probably would still be considered good if they meet current FRA standards.
